Morgan, Akins & Jackson’s Florida Office Obtains Dismissal in Aviation Case

Patrick Dahl and Michelle Arau, a Partner and Associate, respectively, in the Florida office, recently obtained a dismissal with prejudice on behalf of an airline client in an aviation case.  Plaintiff filed his Complaint in the U.S. District Court for the Southern District of Florida, alleging that he was improperly placed on a no-fly list, which negatively impacted his career in the form of a lost pension.  Attorneys Dahl and Arau filed a Motion to Dismiss, arguing that the Airline Deregulation Act preempts Plaintiff’s common law claim.  The Magistrate assigned to the matter agreed with this position, and recommended dismissal of the case.  Plaintiff appealed and the Judge assigned to the matter, following review of additional submissions from both sides, adopted the Magistrate’s holding, dismissing the matter with prejudice.
